Preâmbulo
Estes Termos de Serviço (doravante denominados "estes Termos") estabelecem as condições para o uso da plataforma de comunidade de montanha "YAMATOMO" (doravante denominada "o Serviço") fornecida pela YAMATOMO Operations (doravante denominada "a Empresa"). Todos os usuários (doravante denominados "Usuários") devem concordar com estes Termos antes de usar o Serviço.
O Serviço é uma plataforma comunitária que conecta pessoas que apreciam montanhas, oferecendo recursos como correspondência de amigos de montanha (yamatomo), criação e participação em comunidades, chat de montanha, mensagens diretas, chat em grupo, chat em grupo de comunidade, busca de yamatomo próximos, informações de lojas parceiras e certificação de guia. Os Usuários utilizam o Serviço por sua própria conta e risco.
Montanhismo e caminhadas são atividades inerentemente perigosas. A Empresa não é responsável por quaisquer acidentes, lesões, doenças ou danos que possam ocorrer durante atividades de montanha realizadas por meio do Serviço. Os Usuários devem garantir sua própria segurança e participar de atividades de montanha por sua própria conta e risco.
Capítulo 1: Disposições Gerais
Artigo 1 (Aplicação)
Parágrafo 1 (Âmbito de Aplicação)
Estes Termos se aplicam a todas as relações relacionadas ao uso do Serviço entre os Usuários e a Empresa.
Parágrafo 2 (Disposições Suplementares)
A Empresa pode estabelecer disposições individuais, termos adicionais ou diretrizes (doravante coletivamente denominados "Disposições Individuais") para o Serviço além destes Termos. Estas Disposições Individuais constituirão parte destes Termos.
Parágrafo 3 (Prioridade)
Em caso de discrepância entre estes Termos e as Disposições Individuais, as Disposições Individuais prevalecerão, salvo disposição em contrário nas Disposições Individuais.
Artigo 2 (Definições)
Nestes Termos, os seguintes termos terão os significados estabelecidos abaixo:
"O Serviço" means the mountain community platform "YAMATOMO" provided by the Company, including all related services, features, and content.
"Usuário" means any individual who uses the Service in accordance with these Terms.
"Informações da Conta" means the authentication information (Apple ID information, Google account information, or other authentication information), user ID, and other information managed in connection with the use of the Service.
"Informações do Perfil" means information that Users set in the Service, including nickname, profile image, date of birth, gender, self-introduction, hiking experience, preferred mountains, external links, and other information.
"Conteúdo Publicado" means text, images, photographs, and other content that Users post, transmit, or display through the Service.
"Comunidade" means a group created by Users within the Service for activities such as mountain climbing and hiking.
"Loja Parceira" means a store or facility that has entered into a partner agreement with the Company and provides information or benefits to Users through the Service.
"Plano Premium" means the paid subscription service provided within the Service, to which Article 9-2 applies.
"Membro Premium" means a User who has subscribed to the Premium Plan.
"Membro Gratuito" means a User who has not subscribed to the Premium Plan.
"Usuário Certificado como Guia" means a User who has received guide certification through the guide certification feature of the Service.
"Comunidade Paga" means a community that requires a participation fee.
"Dados Pessoais" has the meaning defined in the Company's Privacy Policy.
"Serviço de Informações Meteorológicas" refere-se à funcionalidade dentro do Serviço que fornece aos Utilizadores informações meteorológicas obtidas de provedores de dados meteorológicos externos como a JMA (Japan Meteorological Agency) ou Open-Meteo através da tela de detalhe do chat de montanha e da tela de detalhe da montanha.
"Função de participação automática no chat de montanha" refere-se à função que, com base nas informações de localização do Utilizador, faz com que os Utilizadores que se encontram dentro de um raio de 5 km de uma montanha específica participem automaticamente no chat de montanha dessa montanha para o dia em questão.
Capítulo 2: Contas
Artigo 3 (Registro de Conta)
Parágrafo 1 (Método de Registro)
Users shall register for the Service using the authentication method designated by the Company (Sign in with Apple, Sign in with Google, or other authentication methods designated by the Company).
Parágrafo 2 (Conclusão do Registro)
Account registration shall be completed when the Company approves the registration application. Upon completion of registration, a usage agreement for the Service shall be established between the User and the Company.
Parágrafo 3 (Recusa de Registro)
The Company may refuse registration in the following cases:
When the registration applicant has violated these Terms in the past
When false information is included in the registration information
When the Company otherwise determines that registration is inappropriate
Artigo 4 (Gerenciamento de Conta)
Parágrafo 1 (Obrigação de Gerenciamento)
Users shall appropriately manage their account information at their own responsibility. Users shall not allow third parties to use their account information, nor shall they transfer, lend, or otherwise dispose of it to third parties.
Parágrafo 2 (Isenção de Responsabilidade)
The Company shall not be liable for any damage arising from the use of a User's account by a third party, unless there is intentional misconduct or gross negligence on the part of the Company.
Artigo 5 (Informações do Perfil)
Parágrafo 1 (Configuração das Informações do Perfil)
Users may set their profile information within the scope designated by the Company. Users shall not set profile information that falls under any of the following:
False information
Information that infringes on the rights of third parties (including intellectual property rights, portrait rights, and privacy rights)
Information that is obscene, violent, or otherwise contrary to public order and morals
Information that may constitute defamation or insult
Other information that the Company deems inappropriate
Parágrafo 2 (Visibilidade do Perfil)
User profile information (nickname, user ID, profile image, hiking experience, preferred mountains, external links, number of yamatomo friends, joined communities, reviews, self-introduction, etc.) shall, as a general rule, be viewable by other Users.
Users may change the public/private setting of their profiles from the My Page screen. When set to private, the display range of detailed profile information shall be limited.
However, basic information such as nickname, user ID, and profile image shall be displayed to other Users regardless of the settings.

Mountain information provision feature
Partner shop information provision feature

Notification feature
Paid community feature (community with participation fees)
Album feature (photo sharing feature within communities)
User search feature (search by user ID, search by name)
QR code feature (sharing user profiles via QR code)
AI community creation feature (community creation support feature using AI)
Serviço de Informações Meteorológicas: exibição de previsões meteorológicas e alertas meteorológicos na tela de detalhe do chat de montanha e na tela de detalhe da montanha, com base em dados meteorológicos externos da JMA (Japan Meteorological Agency) ou do Open-Meteo
Função de participação automática no chat de montanha: Com base nas informações de localização, os Utilizadores que se encontram dentro de 5 km de uma montanha específica são automaticamente inscritos no chat de montanha do dia e automaticamente removidos quando saem da área
Other features that the Company deems appropriate
Parágrafo 2 (Detalhes do Serviço)
The details, scope, and conditions of the Service shall be as specified by the Company in the Service or on the Company's website.
Artigo 7 (Taxas)
Parágrafo 1 (Uso Gratuito)
The basic features of the Service may be used free of charge. However, communication fees required for using the Service shall be borne by the User.
Parágrafo 2 (Serviços Pagos)
When the Company provides paid services, the fees and payment conditions shall be separately determined by the Company and presented within the Service.
Artigo 8 (Modificação do Serviço)
Parágrafo 1 (Direito de Modificar)
The Company may, at its discretion, modify, add to, or discontinue the content of the Service without prior notice to Users.
Parágrafo 2 (Isenção por Modificação)
The Company shall not be liable for any damage incurred by Users as a result of any modification, addition, or discontinuation of the content of the Service.
Artigo 9 (Ambiente de Uso)
Parágrafo 1 (Responsabilidade do Usuário)
Users shall prepare the communication equipment, software, and other items necessary for using the Service at their own expense and responsibility.
Parágrafo 2 (Ambientes Suportados)
The Service is provided as an iOS application. Users shall use the Service on devices that meet the system requirements specified by the Company.
Even in the supported environment specified by the Company, the operation of the Service is not guaranteed under all conditions.
Capítulo 3-2: Plano Premium
Artigo 9-2 (Plano Premium)
Parágrafo 1 (Visão Geral)
The Company provides the Premium Plan as a paid subscription service within the Service. The Premium Plan allows Users to use additional features and expanded usage limits beyond those available with free membership.
Parágrafo 2 (Recursos do Plano Premium e Limites do Membro Gratuito)
Free Members may use the Service subject to the following usage limits. Specific limits are managed through Firebase Remote Config (provided by Google LLC) and may be changed at the Company's discretion.
Premium Members may use features without the above limits (or with expanded limits). Details of Premium Plan features are presented within the Service and on the Company's website.
Parágrafo 3 (Assinatura e Pagamento)
Subscription to the Premium Plan is processed through the Apple App Store in-app purchase mechanism (hereinafter referred to as "App Store IAP").
Subscription fees, billing cycles, and other payment conditions for the Premium Plan follow the terms of the App Store IAP.
Subscription fees are billed at the beginning of each billing cycle in accordance with App Store IAP terms.
Parágrafo 4 (Renovação Automática)
The Premium Plan automatically renews unless the User cancels the subscription before the end of the current billing cycle.
Cancellation of automatic renewal shall be performed by the User through the device settings or App Store account management.
Parágrafo 5 (Cancelamento e Reembolso)
After cancellation of the Premium Plan, the User may continue to use Premium features until the end of the current billing cycle.
Refunds for the Premium Plan follow Apple Inc.'s App Store refund policy. The Company cannot directly process refunds.
Parágrafo 6 (Alterações no Plano Premium)
The Company may change the content, features, prices, and other conditions of the Premium Plan.
When making significant changes, the Company shall notify Users in advance through in-app notifications, the Company's website, or other appropriate methods.
Parágrafo 7 (Teste Gratuito)
The Company may offer a free trial period for the Premium Plan.
The conditions and period of the free trial follow the terms presented in the Service and the terms of the App Store IAP.
Upon expiration of the free trial period, the subscription automatically converts to a paid subscription unless the User cancels the subscription.
Parágrafo 8 (Compensação por Serviço de Guia)
Guide Certified Users may receive compensation for guide services through the paid community feature.
The compensation amount shall be determined between the Guide Certified User and participating Users.
The Company acts as an intermediary platform facilitating the connection between Guide Certified Users and participating Users and is not a party to the guide service contract.
The Company shall not be liable for any damage arising from guide services.
Capítulo 3-3: Recursos Assistidos por IA
Artigo 9-3 (Recursos Assistidos por IA)
Parágrafo 1 (Visão Geral)
The Service provides AI-assisted features (hereinafter referred to as "AI Features") using the Claude API provided by Anthropic, PBC. AI Features are provided to assist Users with community creation.
Parágrafo 2 (Escopo dos Recursos de IA)
AI Features include, but are not limited to, the following:
Community description draft generation
Other content generation assistance that the Company deems appropriate
Parágrafo 3 (Limitações dos Recursos de IA)
Content generated by AI Features is provided as suggestions and is not guaranteed to be accurate, complete, or appropriate.
Users are responsible for reviewing, editing, and confirming AI-generated content before use.
The Company shall not be liable for any damage arising from the use of AI-generated content.
Parágrafo 4 (Limites de Uso)
Usage limits for AI Features may differ between Free Members and Premium Members. Specific limits are managed through Firebase Remote Config and may be changed at the Company's discretion.
The Company may set daily usage limits for AI Features.
Parágrafo 5 (Tratamento de Dados)
Text messages and conversation history entered by Users in AI Features are sent to Anthropic, PBC's servers for processing.
Anthropic, PBC guarantees, under its API terms of service, that submitted data will not be used for AI model training.
For details on the handling of data by Anthropic, PBC, please refer to the Company's Privacy Policy.
Capítulo 4: Conteúdo
Artigo 10 (Conteúdo Publicado)
Parágrafo 1 (Responsabilidade do Usuário)
Users are responsible for the content they post through the Service. Users shall not post content that falls under any of the following:
Content that infringes on the intellectual property rights, portrait rights, privacy rights, or other rights of third parties
Content that is obscene, violent, or otherwise contrary to public order and morals
Content that constitutes defamation or insult
False or misleading content
Content that promotes or facilitates illegal activities
Content that contains computer viruses or other harmful programs
Content that may interfere with the operation of the Service

Parágrafo 2 (Direitos sobre Conteúdo Publicado)
Intellectual property rights to Posted Content belong to the User who posted them. However, by posting content through the Service, the User grants the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content for the purpose of providing and promoting the Service.
The license granted in the preceding paragraph shall survive even after the User withdraws from the Service or the Posted Content is deleted, to the extent necessary for the operation of the Service.
Users shall not exercise moral rights against the Company or parties licensed by the Company with respect to Posted Content.
Parágrafo 3 (Exclusão de Conteúdo)
The Company may, without prior notice, delete or make invisible Posted Content that falls under any of the items of Paragraph 1 or that the Company otherwise deems inappropriate.
The Company shall not be liable for any damage incurred by Users as a result of the deletion or invisibility of Posted Content.
Artigo 11 (Conteúdo Proibido)
Users shall not post the following content through the Service:
Content that promotes illegal drug use
Content that promotes weapons, explosives, or dangerous substances
Content that promotes suicide or self-harm
Content related to child exploitation
Content that promotes discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other attributes
Content that promotes specific political or religious views
Content that constitutes spam or unauthorized advertising
Content that may facilitate the identification of individuals (publishing another person's real name, address, workplace, school, etc. without consent)
Content involving commercial transactions, solicitation of other services, multi-level marketing, or similar activities

Artigo 12 (Tratamento de Conteúdo Publicado)
Parágrafo 1 (Monitoramento)
The Company may monitor Posted Content to ensure compliance with these Terms. However, the Company is not obligated to monitor all Posted Content.
Parágrafo 2 (Denúncias de Usuários)
Users may report to the Company any Posted Content that they believe violates these Terms. The Company shall review the reported content and take appropriate measures if necessary.
Artigo 12-2 (Disposições Especiais para Conteúdo Fotográfico)
Parágrafo 1 (Recurso de Álbum)
Users may upload and share photos within communities using the album feature.
Uploaded photos shall be viewable by members of the applicable community.
Parágrafo 2 (Direitos sobre Conteúdo Fotográfico)
Copyright and other intellectual property rights to photos uploaded by Users belong to the User who uploaded them.
By uploading photos, Users grant the Company a license equivalent to that set forth in Article 10, Paragraph 2.
Parágrafo 3 (Considerações de Privacidade para Conteúdo Fotográfico)
Users shall exercise caution to ensure that photos do not contain information that may identify third parties (faces, license plates, expressions, etc.) without their consent.
The Company may remove EXIF information (shooting location, date and time, camera information, etc.) from uploaded photos for privacy protection purposes.
Capítulo 5: Atividades Proibidas
Artigo 13 (Atividades Proibidas)
Users shall not engage in the following activities when using the Service:
Activities that violate laws, regulations, or court orders
Activities related to criminal acts
Activities that infringe on the intellectual property rights, portrait rights, privacy rights, reputation, or other rights or interests of the Company, other Users, or third parties
Activities that transmit excessively violent expressions, explicit sexual expressions, expressions that constitute discrimination based on race, nationality, creed, gender, social status, family origin, etc., expressions that induce or encourage suicide, self-harm, or drug abuse, or other antisocial content that causes discomfort to others
Activities aimed at commercial purposes, advertising, solicitation, or other economic benefits not approved by the Company (excluding those approved by the Company)
Activities that benefit or cooperate with antisocial forces
Activities intended to meet strangers of the opposite sex for romantic or sexual purposes
Activities that directly or indirectly cause disadvantage or damage to the Company, other Users, or third parties

Unauthorized access or attempts to do so
Activities that collect or store personal information of other Users
Activities that impersonate other Users or third parties
Activities that directly or indirectly provide benefits to antisocial forces in connection with the Service
Creation or use of multiple accounts by the same person
Activities that may lead to the misidentification of the Company or a third party, or that endorse or are associated with the Company or a third party
Activities aimed at collecting or obtaining personal information, registered information, or usage history of other Users
Activities that use the Service for political activities, electoral activities, religious activities, or similar purposes
Stalking or harassment of other Users
Manipulation, falsification, or falsification of evaluation, reviews, or other information within the Service
Use of automated programs (bots, crawlers, scrapers, etc.) to access the Service
Activities that place an excessive load on the Service's servers or network
Reverse engineering, decompiling, disassembling, or other analysis of the Service's software

Artigo 14 (Medidas Contra Violações)

When a User engages in any activity falling under the preceding article, the Company may, without prior notice, take the following measures:
Deletion of the relevant Posted Content
Restriction of use of all or part of the Service
Suspension or deletion of the account
Other measures that the Company deems appropriate
Parágrafo 2 (Isenção de Responsabilidade)
The Company shall not be liable for any damage incurred by Users as a result of measures taken under this article.
Capítulo 6: Relacionamentos Entre Usuários
Artigo 15 (Relacionamentos Entre Usuários)
Parágrafo 1 (Autorresponsabilidade)
Interactions and relationships between Users through the Service are conducted at each User's own risk and responsibility. The Company shall not be liable for disputes, damages, or other issues arising between Users.
Parágrafo 2 (Resolução de Disputas)
In the event of a dispute between Users, the Users involved shall resolve the dispute through consultation between themselves. When the Company deems it necessary, the Company may mediate or take other measures, but is not obligated to do so.
Artigo 16 (Comunidade)
Parágrafo 1 (Criação de Comunidade)
Users may create communities within the Service in accordance with the conditions set by the Company.
Community creators are responsible for managing the communities they create.
Parágrafo 2 (Participação em Comunidade)
Users may participate in communities within the Service subject to the conditions of each community.
Users shall comply with the rules of the communities they join.
Parágrafo 3 (Exclusão de Comunidade)
Community creators may delete the communities they created.
The Company may delete a community without prior notice if it deems the community to be in violation of these Terms or otherwise inappropriate.
Artigo 16-2 (Moderação de Comunidade)
Parágrafo 1 (Autoridade do Moderador)
Community creators and Users designated as moderators (hereinafter collectively referred to as "Moderators") may exercise the following moderation authority:
- Removal of community members
- Deletion of messages within the community
- Modification of community settings
- Other management actions necessary for community operation
Moderators shall exercise their moderation authority appropriately and shall not abuse it.
Parágrafo 2 (Intervenção da Empresa)
When the Company determines that a Moderator's exercise of moderation authority is inappropriate, the Company may override the moderation decision or take other necessary measures.
The Company's intervention does not mean that the Company is obligated to monitor or manage all communities.
Parágrafo 3 (Isenção de Responsabilidade)
The Company shall not be liable for any damage incurred by Users as a result of a Moderator's exercise of moderation authority, except in cases of intentional misconduct or gross negligence by the Company.
Capítulo 7: Interrupção e Modificação do Serviço
Artigo 17 (Interrupção do Serviço)
Parágrafo 1 (Motivos para Interrupção)
The Company may, without prior notice to Users, suspend or interrupt the provision of all or part of the Service in the following cases:
When performing maintenance, inspection, or updating of the computer system related to the Service
When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, natural disasters, or the spread of infectious diseases
When a computer or communication line is shut down due to an accident
When the infrastructure services used for operating the Service (Firebase (Google LLC), Apple Inc., Stripe, Inc., etc.) experience failures or interruptions
When the Company otherwise determines that suspension or interruption of the Service is necessary
Parágrafo 2 (Isenção de Responsabilidade)
The Company shall not be liable for any disadvantage or damage incurred by Users or third parties as a result of the suspension or interruption of the Service.
Artigo 18 (Encerramento do Serviço)
Parágrafo 1 (Direito de Encerrar)
The Company may terminate the provision of the Service by notifying Users in advance through means the Company deems appropriate.
Parágrafo 2 (Isenção de Responsabilidade)
The Company shall not be liable for any damage incurred by Users as a result of the termination of the Service.
Capítulo 8: Atividades de Montanha e Segurança
Artigo 19 (Atividades de Montanha)
Parágrafo 1 (Autorresponsabilidade)
Mountain activities (mountain climbing, hiking, trekking, and all other mountain-related activities) conducted through the Service are performed at each User's own risk and responsibility. Users must ensure their own safety.
Parágrafo 2 (Obrigação de Preparação)
When engaging in mountain activities, Users shall prepare the following:
Appropriate equipment and clothing
Sufficient physical fitness and skills
Activity plan (including route, schedule, and emergency contacts)
Checking weather information
Submission of a climbing notification (when necessary)
Consideration of mountain insurance enrollment
Other preparations that the User deems necessary
Parágrafo 3 (Resposta a Emergências)
In the event of an emergency during mountain activities, Users shall contact the appropriate authorities (police 110, fire department 119, etc.) themselves. The Service is not an emergency reporting system.
Artigo 19-2 (Isenção Sobre a Precisão de Informações de Montanha)
Parágrafo 1 (Natureza das Informações de Montanha)
Mountain-related information provided through the Service (including but not limited to mountain names, elevations, difficulty ratings, routes, estimated times, required equipment, and weather information) is for reference purposes only and does not guarantee accuracy, completeness, or currency.
Paragraph 2 (User Responsibility)
Users shall also refer to information from public authorities, experts, and local sources, and shall not rely solely on information obtained through the Service when engaging in mountain activities. Users shall act at their own judgment and responsibility.

The Company shall not be liable for any damage arising from mountain activities conducted based on information provided through the Service.
Artigo 19-3 (Serviço de Informações Meteorológicas)
Parágrafo 1 (Natureza das Informações Meteorológicas)
O Serviço exibe previsões meteorológicas (previsão de 7 dias) e informações sobre alertas meteorológicos na tela de detalhe do chat de montanha e na tela de detalhe da montanha, com base em dados meteorológicos publicados pela JMA (Japan Meteorological Agency, doravante "JMA") (para montanhas no Japão) ou obtidos do Open-Meteo (uma API meteorológica de código aberto fornecida pela Open-Meteo GmbH) (para montanhas fora do Japão).
As informações fornecidas pelo serviço de informações meteorológicas são exclusivamente informações de referência. A Empresa não oferece nenhuma garantia quanto à sua precisão, integridade, atualidade ou atualização em tempo real.
O serviço de informações meteorológicas exibe dados obtidos de provedores de dados meteorológicos externos; a Empresa não realiza observações ou previsões meteorológicas independentes. Na exibição dos dados podem ser realizados processamentos de representação visual como a conversão de códigos numéricos em ícones, mas o conteúdo dos dados meteorológicos em si não é modificado ou processado de forma independente. A Empresa não possui autorização para o serviço de previsão nos termos da Lei de Serviços Meteorológicos (Lei Nº 165 de 1952) e esta funcionalidade não é fornecida como "serviço de previsão" nos termos dessa lei.
As previsões meteorológicas exibidas no serviço de informações meteorológicas são previsões regionais para a área onde a montanha está localizada. As condições meteorológicas reais perto do cume (temperatura, velocidade do vento, precipitação, etc.) podem diferir significativamente da previsão exibida. Em geral, a temperatura diminui aproximadamente 0,6°C a cada 100 metros de elevação. Os utilizadores devem compreender este aspeto antes de consultar as informações meteorológicas.
Parágrafo 2 (Fontes de Dados e Atualização)
Para montanhas no Japão, são utilizados exclusivamente os dados publicados pela JMA, em conformidade com a Lei de Serviços Meteorológicos e outras leis aplicáveis. Para montanhas fora do Japão, são utilizados exclusivamente os dados do Open-Meteo.
As informações meteorológicas são armazenadas periodicamente em cache e as atualizações em tempo real podem não estar disponíveis. As informações exibidas podem diferir das condições meteorológicas reais.
Devido a falhas nas fontes de dados externas, alterações nas especificações da API, interrupções nas comunicações ou outros motivos, as informações meteorológicas podem não estar disponíveis temporária ou continuamente.
Parágrafo 3 (Exibição de Alertas Meteorológicos)
O Serviço pode exibir alertas meteorológicos (alerta de tempestade, alerta de chuvas intensas, etc.), avisos (aviso de vento forte, aviso de trovoada, etc.) e alertas especiais emitidos pela JMA.
Os alertas e avisos exibidos não compreendem necessariamente todos os alertas e avisos emitidos pela JMA, e não se garante que a exibição seja simultânea à emissão pela JMA.
Ao realizar atividades de montanha, os Utilizadores não devem basear-se exclusivamente na exibição de alertas do presente Serviço, mas devem consultar o site oficial da JMA, as informações meteorológicas da televisão e rádio, as informações dos refúgios de montanha e outras fontes de informação.
Parágrafo 4 (Isenção de Responsabilidade)
A Empresa não será responsável por quaisquer danos sofridos pelos Utilizadores decorrentes de ou em conexão com erros, atrasos, incompletude ou falhas nas fontes de dados das informações meteorológicas fornecidas através do serviço de informações meteorológicas.
A decisão de realizar ou cancelar atividades de montanha com base nas informações meteorológicas cabe ao próprio Utilizador, e a Empresa não assume qualquer responsabilidade por essa decisão.
Mesmo que o Serviço não exiba alertas ou avisos meteorológicos e o Utilizador não consiga reconhecer a emissão de um alerta meteorológico, a Empresa não assume qualquer responsabilidade.
Parágrafo 5 (Indicação de Fontes)
A fonte dos dados meteorológicos exibidos no serviço de informações meteorológicas é indicada dentro da aplicação. Quando os Utilizadores comunicarem informações meteorológicas a terceiros, devem indicar claramente que se trata de informações de referência.
Artigo 19-4 (Função de participação automática no chat de montanha)
Parágrafo 1 (Visão geral da função)
A função de participação automática no chat de montanha faz com que os Utilizadores que se encontram dentro de um raio de 5 km de uma montanha específica participem automaticamente no chat de montanha dessa montanha para o dia em questão, com base nas informações de localização do Utilizador.
A função de participação automática no chat de montanha está ativada por padrão (ON). Os Utilizadores podem desativá-la (OFF) a qualquer momento a partir do ecrã de definições do Serviço.
Quando a função de participação automática no chat de montanha é desativada, o Utilizador sai de todos os chats de montanha aos quais se tinha juntado automaticamente. Os chats de montanha aos quais se juntou manualmente não são afetados.
Parágrafo 2 (Tratamento das informações de localização)
A função de participação automática no chat de montanha recolhe informações de localização apenas quando a aplicação está em execução em primeiro plano. Não são recolhidas informações de localização em segundo plano.
As informações de localização da função de participação automática no chat de montanha são processadas exclusivamente no dispositivo (localmente) e não são transmitidas aos servidores da Empresa. Apenas o ID da sala do chat de montanha ao qual se participou automaticamente é registado no dispositivo.
As informações relativas à participação automática são repostas todos os dias às 0:00 (hora do Japão).
Parágrafo 3 (Participação automática e saída automática)
Quando um Utilizador entra num raio de 5 km à volta de uma montanha, participa automaticamente no chat de montanha dessa montanha para o dia em questão.
Quando um Utilizador sai do raio de 5 km à volta de uma montanha, sai automaticamente do chat de montanha ao qual tinha participado automaticamente.
A determinação da participação automática e da saída automática depende da precisão GPS do dispositivo, pelo que a posição real e o resultado da determinação podem diferir. A Empresa não fornece qualquer garantia relativamente à precisão da participação automática e da saída automática.
Parágrafo 4 (Exclusão de responsabilidade)

Users may apply for guide certification through the guide certification feature of the Service.

The Company shall review guide certification applications based on the submitted certification documents.
The Company may approve or reject the application at its discretion.

Users who receive guide certification will have a guide certification badge displayed on their profile.
Guide certification indicates that the Company has confirmed the certification document image and does not guarantee the User's actual guiding ability, skills, experience, or safety management capabilities.

The Company may revoke guide certification if the Company determines that the certified User falls under any of the following:
When the submitted certification document is found to be false or forged
When the User violates these Terms
When the Company otherwise deems it necessary

The Company shall not be liable for any damage arising from guide services provided by Guide Certified Users, except in cases of intentional misconduct or gross negligence by the Company.

The Company provides information about partner shops through the Service. This information includes the store name, location, business hours, services, coupon information, and other information.

Reviews shall be based on the User's actual experience and shall be posted accurately and fairly.

The Company may delete or make invisible reviews that violate these Terms or that the Company deems inappropriate.
The Company shall not be liable for any damage incurred by Users as a result of such deletion or invisibility.

Partner shops may issue coupons (hereinafter referred to as "Coupons") through the Service.
The content, conditions, validity period, and other details of Coupons are determined by each partner shop.

Users may use Coupons by presenting them at the applicable partner shop in accordance with the conditions of each Coupon.
Coupon usage may require verification through the slide-to-redeem mechanism or other verification methods designated by the Company.
Once a Coupon has been used, it cannot be reused.
Parágrafo 3 (Limites de Uso)
The Company may set limits on the number of Coupons that can be used per day.
Usage limits may differ between Free Members and Premium Members.

The Company does not guarantee the content, quality, safety, or legality of the goods or services provided through Coupons.
Disputes arising from Coupon usage shall be resolved directly between the User and the partner shop.

Disputes arising from transactions with partner shops (including but not limited to product defects, service deficiencies, and Coupon redemption issues) shall be resolved through consultation between the User and the partner shop.

When the Company deems it necessary, the Company may mediate between the User and the partner shop. However, the Company is not obligated to mediate and shall not be liable for the outcome of any mediation.

The Service provides payment functionality for paid communities using the payment infrastructure provided by Stripe, Inc. (hereinafter referred to as "Stripe").

Payments for paid community participation fees are processed through Stripe Payments.
The Company does not directly handle credit card numbers, bank account information, or other payment method details. These are collected and managed directly by Stripe.

Community creators of paid communities may receive revenue through Stripe Connect.
To receive revenue, community creators must create a Stripe Connect account and complete the required identity verification and setup procedures.
Revenue transfers are subject to platform fees (commissions) set by the Company.

The Company deducts platform fees from paid community participation fees. The specific fee rates are presented within the Service.
Platform fees may be changed at the Company's discretion. When making changes, the Company shall notify Users in advance.

Users who use payment features shall also agree to and comply with Stripe, Inc.'s terms of service.
The Company shall not be liable for failures, delays, or errors in Stripe's payment processing.

That the Service will be provided continuously without interruption
That the Service is free of security defects, errors, bugs, malfunctions, rights infringements, or other defects
That the Service does not contain viruses, malware, or other harmful code
That information obtainable through the Service is accurate, complete, current, or useful
That other Users encountered through the Service are safe and trustworthy

Users shall use information obtained through the Service at their own judgment and responsibility, and the Company shall not be liable for any damage arising from actions based on such information.

When Users use third-party services, content, advertisements, or websites, the terms of use, privacy policies, and other terms of such third parties shall apply.
The Service operates on the Firebase platform (authentication, database, cloud storage, Cloud Functions, push notifications, etc.) provided by Google LLC. The terms of use of Google LLC may also apply to the use of Firebase.
The Service uses the payment infrastructure provided by Stripe, Inc. for its payment features. The terms of use of Stripe, Inc. also apply to the use of payment features.
The Service uses the Claude API provided by Anthropic, PBC for its AI-assisted features.
The Service uses the Google Maps API for displaying partner shop location information and other purposes.

The Company shall not be liable for service interruptions or data loss caused by failures of Firebase, Stripe, Anthropic, Google Maps, JMA (Japan Meteorological Agency), Open-Meteo, or other third-party services.

The Company shall not be liable for any damage incurred by Users when the provision of all or part of the Service becomes impossible due to natural disasters, wars, riots, civil disturbances, terrorism, spread of infectious diseases, enactment or amendment of laws, administrative guidance, communication line failures, power supply interruptions, cyber attacks, or other causes not attributable to the Company.

Damage caused by sudden weather changes

Hypothermia, altitude sickness, heat stroke, or other physical conditions
Getting lost or stranded
Damage caused by wild animals or poisonous plants
Damage caused by the negligence of other Users
Criminal victimization (assault, injury, theft, fraud, sexual harm, etc.)
Damages from cancellation of mountain activities or schedule changes
Rescue costs and search costs
Loss or damage of equipment and belongings
Damages related to guide services provided by Guide Certified Users
All other damages related to mountain activities

The Company shall not be liable for any damage arising from mountain activities conducted based on mountain-related information provided through the Service.
When engaging in mountain activities, Users shall not rely solely on information obtained through the Service, but shall also refer to information from public authorities, experts, and local sources, and shall act at their own judgment and responsibility.
Capítulo 13: Danos
Artigo 30 (Escopo dos Danos)

If the contract between the Company and the User based on these Terms constitutes a consumer contract as defined in the Consumer Contract Act, the provisions of these Terms that completely exempt the Company from liability for damages shall not apply, and the Company shall be liable for damages only when the Company causes damage to the User through intentional misconduct or gross negligence.

- With respect to compensation for damages incurred by Users due to the Company's negligence (excluding gross negligence) in breach of obligation or tort, the following limitations shall apply.

The maximum amount of damages shall be the amount of usage fees paid by the User to the Company in the month in which the damage occurred (0 yen if the User is not using paid services).
The provisions of the preceding paragraph shall not apply in cases of intentional misconduct or gross negligence by the Company.

The Company may, without prior notice to the User, take measures such as deletion of Posted Content, restriction of all or part of the Service, suspension of the account, or other measures the Company deems appropriate, if the User falls under any of the following:
When the User violates any provision of these Terms, or when the Company determines that there is a risk of violation
When false information is found in the registration information
When the User fails to respond to communications from the Company for a certain period
When the Service has not been used for more than one year since the last use
When there is a default on payment obligations such as fees
When the User is found to be associated with antisocial forces
When the User engages in acts that damage the credibility of the Company, the Service, other Users, or third parties
When the Company otherwise determines that the use of the Service is inappropriate
Parágrafo 2 (Suspensão de Conta (BAN))
As a measure under the preceding paragraph, the Company may suspend a User's account (BAN).
Users who receive a BAN will be unable to log in to the Service.
A BAN shall remain in effect permanently unless lifted by the Company.
Users who receive a BAN may not create a new account to use the Service.

If a User holds multiple accounts, the Company may take measures against all such accounts.

When the trust relationship with the Company has been lost or the Company otherwise determines that it is difficult to maintain the contractual relationship

If an account is deleted, the User shall lose all rights related to the Service.
Data deleted as a result of account deletion cannot be recovered.
Even after account deletion, some content posted by the User may remain viewable by other Users.

Capítulo 15: Desistência

Users may withdraw from the Service at any time through the withdrawal procedure designated by the Company (procedure from the settings screen within the Service).

Upon withdrawal, the User's account shall be deleted, and the User shall lose all rights related to the Service.
Data deleted as a result of withdrawal cannot be recovered.
Even after withdrawal, some content posted by the User may remain viewable by other Users.
If there are unpaid fees at the time of withdrawal, the User shall remain obligated to pay such fees even after withdrawal.

Upon completion of the withdrawal procedure, the Company shall, as a general rule, delete the User's account information and profile information within 30 days.
Chat messages posted by the User may remain to maintain the context of chats. However, links from such messages to the User's profile information shall be deleted.
Identity verification documents and guide certification documents shall be retained for one year after withdrawal for fraud prevention purposes and then deleted.
Information required to be retained by law shall continue to be stored for the period prescribed by such law.

Unauthorized use of the Company's trademarks, logos, or service names
Other activities that infringe on the Company's intellectual property rights

Being an organized crime group, organized crime group member, associate member, organized crime-related enterprise, corporate racketeer, social movement racketeer, special intelligence violence group, or equivalent thereof (hereinafter referred to as "Antisocial Forces")
Having been a member of Antisocial Forces (within the past 5 years)
Having a socially condemnable relationship with Antisocial Forces
Using Antisocial Forces
Having a relationship of providing funds or other benefits to Antisocial Forces
Engaging in violent demands, unreasonable demands beyond legal responsibility, threatening behavior, spreading rumors, using deception or force to damage the Company's credibility, or interfering with the Company's business, or engaging in similar acts, either personally or through a third party
Parágrafo 2 (Efeito da Violação)
If a User falls under any of the items of the preceding paragraph, the Company may immediately suspend the use of the Service and delete the account without any prior notice. In such cases, the Company shall not be liable for damages to the User.
Capítulo 20: Proibição de Cessão de Direitos e Obrigações

Users may not assign their contractual position under the usage agreement, or rights or obligations under these Terms, to a third party, or offer them as security, without prior written consent of the Company.

When the Company transfers its business related to the Service to a third party (including but not limited to business transfer, company split, merger, or other corporate reorganization), the Company may transfer the contractual position under the usage agreement, rights and obligations under these Terms, and User registration information and other information to such transferee. Users shall consent in advance to such transfer.
Capítulo 21: Divisibilidade

Even if any provision of these Terms is determined to be invalid or unenforceable by law, court judgment, administrative action, or otherwise, the remaining provisions of these Terms shall continue to be fully effective.
Provisions determined to be invalid or unenforceable shall be replaced with the valid provision closest in intent to such provision, or shall be modified to the minimum extent necessary for such provision to be valid and enforceable.

The Company may amend these Terms without obtaining individual consent from Users in the following cases:
When the amendment to these Terms is in the general interest of Users
When the amendment to these Terms does not conflict with the purpose of the usage agreement and is reasonable in light of the necessity of the amendment, the reasonableness of the amended content, and other circumstances related to the amendment

When amending these Terms, the Company shall publicize the content and effective date of the amended Terms through posting within the Service, on the Company's website, or by other methods the Company deems appropriate, a reasonable period before the effective date.
Notwithstanding the preceding paragraph, amendments that are in the general interest of Users need only be publicized before the effective date.

The amended Terms shall take effect from the effective date.
If Users continue to use the Service after the effective date, they shall be deemed to have agreed to the amended Terms.
If Users do not agree to the amended Terms, they may terminate the usage agreement by completing the withdrawal procedure by the effective date.

Notices from the Company to Users regarding the Service shall be given through display within the Service, push notifications within the Service, email to the registered email address, posting on the Company's website, or other methods the Company deems appropriate.

Push notifications for the Service are sent using Apple Push Notification Service (APNs) provided by Apple Inc. and Firebase Cloud Messaging (FCM) provided by Google LLC.
The Company stores device tokens obtained from User devices for the purpose of sending push notifications.
Push notifications may be delayed or undelivered due to network environment, device settings, or other factors. The Company does not guarantee the reliable delivery of push notifications.
Parágrafo 2 (Efeito dos Avisos)
When the Company provides notice through display within the Service or posting on the Company's website, such notice shall take effect at the time of display or posting.
When the Company provides notice by email, such notice shall take effect at the time the Company sends the email.
Even if a notice from the Company fails to reach a User because the User did not keep their registration information up to date, the Company shall not be liable.
Parágrafo 3 (Consentimento para Notificações Push)
By enabling push notification reception in device settings when using the Service, Users agree to receive the following types of push notifications:
- Chat message reception notifications
- Community update notifications
- Yamatomo friend request notifications
- Review notifications
- Service-related announcements
- Other notifications the Company deems necessary
Users may stop receiving push notifications at any time by turning off push notifications in the device's Settings app. However, turning off push notifications may result in the inability to receive important notifications.
The Company shall not be liable for notifications that could not be received due to push notifications being turned off.

Communications from Users to the Company shall be made through the contact form provided within the Service or by email to the email address designated by the Company.

The Company shall, as a general rule, respond to inquiries from Users by email or through in-app notifications.
Parágrafo 3 (Tratamento de Dados de Consulta)
Information submitted through the contact form (name, email address, inquiry content, etc.) is used for responding to inquiries and improving the Service.
Inquiry data shall be retained for three years after the response to the inquiry is completed, unless retention is required by law or reasonably necessary for service improvement, and then deleted.

These Terms shall be governed by and construed in accordance with the laws of Japan, with the Japanese text as the authoritative version.
Artigo 47 (Jurisdição)
In the event of any dispute arising between a User and the Company in connection with these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.

These Terms constitute the entire agreement between the Company and Users regarding the use of the Service, and all oral or written agreements, understandings, representations, warranties, and other matters between the Company and Users prior to the execution of these Terms shall expire, except for those expressly provided in these Terms.

If the Company fails to exercise or delays in exercising any right under these Terms, such failure or delay shall not be deemed a waiver of such right, and shall not prevent the Company from exercising such right thereafter.

These Terms are prepared in the Japanese language. Even if a translated version of these Terms exists, the Japanese version shall be the authoritative text, and in the event of any discrepancy between the Japanese version and the translated version, the Japanese version shall prevail.

By entering into these Terms, Users shall be deemed to have fully understood and agreed to the following:
Mountain climbing is a dangerous activity. There is a possibility of death, serious injury, permanent disability, or other significant damage. Users must engage in mountain activities at their own responsibility and ensure their own safety.
The Company is not an organizer of mountain activities. The Service provides a platform that facilitates communication between Users, and the Company shall not be liable for the planning, operation, or management of mountain activities.
The safety of other Users is not guaranteed. Even Users with identity verification badges are not guaranteed in terms of their character, trustworthiness, or safety. Users must verify the identity of other Users at their own responsibility.
Guide certification does not guarantee ability. Even Users with guide certification badges are not guaranteed in terms of their actual guiding ability, skills, experience, or safety management capabilities. Even when requesting guide services from a certified guide, Users must verify the guide's ability and ensure their own safety at their own responsibility.
The Service is not an emergency reporting system. In the event of an emergency, Users must contact the police (110), fire department (119), or other appropriate authorities.
Mountain activities require adequate preparation. When engaging in mountain climbing, hiking, or other mountain activities, Users must have appropriate equipment, physical fitness, skills, and knowledge, and must make advance preparations (creating activity plans, checking weather conditions, submitting climbing notifications, considering mountain insurance enrollment, etc.).
Information in the Service is for reference only. Mountain-related information provided through the Service is merely reference information, and its accuracy, completeness, and currency are not guaranteed. Users must refer to multiple information sources and act at their own judgment and responsibility.

The Company shall not be liable for any damage incurred by Users arising from or in connection with the Service, except in cases of intentional misconduct or gross negligence by the Company.
The Company shall not be liable for the actions of other Users.
The Company shall not be liable for mountain activities conducted through the Service.
The Company shall not be liable for guide services provided by Guide Certified Users.
The Company makes no warranty whatsoever regarding the content, continuity, or safety of the Service.
Users shall use the Service, interact with other Users, and engage in mountain activities at their own responsibility.
